Carbonell Pleads Guilty to Battery

The Key West 19-year old who stomped a homeless man in November 2004 just weeks before he was to begin a four-year prison term for armed robbery pleaded guilty to aggravated battery before Circuit Judge Mark Jones today.

If Judge Jones rules that Jeffrey Jay Carbonell, now 21, is a “habitual violent felony offender,” he faces 10 years behind bars without the possibility of early release for good behavior, followed by probation.

Carbonell was arrested in May 2003, along with an accomplice, for the armed robbery of a man at Mallory Square.  Aiming a .32 caliber handgun at his victim’s face, he made off with a chain and a cap.  Carbonell was 17 years old at the time of the robbery.

Out of jail on bond, Carbonell attacked a patron of the 801 Bar on Duval Street in February 2004.  With a friend restraining his victim, Carbonell struck the man in the face while shouting insults about  the man’s sexual orientation.  He was charged with “battery evincing prejudice” – a hate crime.

In October of that year, Carbonell pleaded guilty to both crimes.  Judge Richard Payne sentenced him to four years in state prison.  But over the strenuous objection of prosecutors, Payne allowed Carbonell to begin his sentence that December. 

About two weeks before he was scheduled to begin his jail term, Carbonell committed his latest battery on a homeless man near Mallory Square.

Assistant State Attorney Mark Wilson prosecuted the case for the State Attorney’s office.

Sentencing is scheduled for May 25 before Judge Jones.
